1. Basic concepts

Website is a set of information resources located on the Internet at the following web address http://ism-shop.ru/. The Website is owned and administered by BSF SERVICE LLC.

Registration on the Website means the process by which a legally capable individual aged 18 years or older provides individual information about him/herself to the Seller, which is used to create an Account that allows to place Orders for the Products, subscribe to mailing list, use feedback form.

Account is a set of data about the Customer that is necessary for identification and provides access to the Customer's personal data and settings. An Account enables placing Orders for the Products, subscribing to mailing list, using feedback form.

User is a person who has come to the Website.

Customer is an individual who has registered on the Website.

Seller - BSF SERVICE LLC (Сompany registration number: 1147746078149, TRN: 7716765469, registered at 121614 Moscow Krylatskaya Street, 12, bld. 4, area 120).

Online shop is the trading platform placed on the Website.

Order is the process of acquisition of Products by the registered Customer through the Online shop.

Product is an object that is offered for sale in the Online shop placed in the corresponding section of the Online shop.

Personal data - any information that relates to a directly or indirectly identified or identifiable individual.

Processing of personal data means any action (operation) or a combination of actions (operations) performed both automatically and manually with personal data, including collection, recording, arrangement, accumulation, storage, rectification (updating, changing), extraction, use, transfer (including transfer of data to third parties for the purposes of their processing in the cases provided for in the present Policy), anonymizing, blocking and destruction of personal data.

1.2. The present Policy regulates the legal relationship regarding the processing of personal data between the Seller and the Customer and the legal relationship regarding the use of the Website between the Seller and the User. The Seller is the operator of personal data.

1.3. By using the Website's services the User gives an unconditional consent to the present Policy and the personal data processing terms specified therein. In case of disagreement with the present Policy the User should refrain from using the services.

2. Processing of personal data

2.1 The retention and processing of personal data of the Customer shall be valid until the expiry of the purpose of personal data processing or withdrawal of consent for processing of personal data.

2.2 Personal data of the Customer shall be processed in accordance with the Federal Law of 27 July 2006 N 152-FZ ON PERSONAL DATA.

2.3 When processing personal data the Seller shall take the necessary and sufficient organisational and technical measures to protect personal data from an unauthorised or accidental access, destruction, modification, blocking, copying, distribution, as well as from any other unlawful actions of third parties.

2.4. The Seller may process the following categories of Personal Data during the use of the Website:

Personal Data provided by Customer when registering (creating an account), subscribing to the mailing list or completing the feedback form: such as Surname, First Name, Patronymic, contact telephone number, email address, address for order delivery;
Electronic data (HTTP headers, IP address, cookies, web beacons/pixel tags, browser ID data, hardware and software information);
Date and time of accessing the Website;
Information about the User/Customer's activity during the use of the Website;
Information about User/Customer's geolocation (in order to determine the nearest sales outlet to the User);
Other information about the User/Customer required for processing in accordance with the terms governing the use of the Website.

2.5 Processing of personal information by means of cookies and counters.

2.5.1 User/Customer’s cookies are used by the Seller to provide User/Customer with personalised use options, for statistical and research purposes, as well as to improve the options. Cookies are not transferred to third parties.

2.5.2 The User/Customer is aware that the hardware and software used for the use may have the function of disabling cookie operations (for any or certain websites) and of deleting previously received cookies.

2.5.3 The Seller is entitled to establish that the granting of certain use options is only possible if the acceptance and receipt of cookies is authorised by the User/Client.

2.5.4. The structure of the cookie, its content and technical parameters are determined at the Seller's discretion and are subject to change without prior notice to the User/Client.

2.5.5 The counters placed by the Seller may be used to analyse the User/Customer's cookie, to collect and process statistical information and for other purposes. The technical parameters of meter operation are determined by the Seller and are subject to change without prior notice to the User/Customer.

3. Provision of information

3.1 When registering on the Website the Customer provides the following personal data: Surname, First Name, Patronymic, contact telephone number, email address, address for order delivery.

3.2 When subscribing to the mailing list to receive promotional and informational messages (newsletters), the Customer provides the following personal data: email address.

3.3. When completing the feedback form the Customer provides the following personal data: Surname, First Name, Patronymic and email address.

3.4 The Customer is obliged to update and supplement the personal data provided if this information changes.

4. Use of information provided by the Customer and received by the Seller

4.1 The Seller shall process the information received for the following purposes:

To register the User on the Website and to maintain the Account (if the User decides to register on the Website);
To fulfil the Seller's obligations to the Customer, including:

To evaluate and analyse the performance of the Online shop and the Seller's system, analyse Customer’s purchasing habits and provide personal recommendations;
To restore the password from an Account on the Website of the Customer;
To send out promotional and informational messages (newsletters) through email and communicate our news and special offers by (but not limited to) SMS-services (if the Customer is subscribed to mailing list);
To monitor customer satisfaction with the services of the Online shop.

4.2 Pursuant to Part 1 of Article 18 of the Federal Law On Advertising the Seller has the right to send promotional and informational messages (newsletters) to the Customer if the Customer gave his consent to it by subscribing to receive such messages through entering the email address into a special field on the Website suggesting a Customer to subscribe and then pressing the relevant confirmation button or by ticking the relevant box upon registration. If the Customer does not wish to receive newsletters from the Seller, the Customer may opt out of receiving such newsletters from the Online shop by notifying the Seller through email: ism-shop@internationalschool.ru. Subscription to the mailing list is only available to registered Users.

4.3 The Seller shall use the information received solely for the purposes specified in the present Policy.

5. Disclosure and transfer of information received by the Seller

5.1. The Seller undertakes not to disclose information received from the Customer. The transfer of information to agents, vendors and third parties acting on the basis of an agreement with the Seller in order to perform obligations to the Customer shall not be deemed a breach of obligations.

5.2 The transfer of anonymized personal data of the Customer to third parties for the purpose of evaluating and analysing the performance of the Online shop and the Seller's system, analysing the Customer's purchasing habits and providing personal recommendations shall not be deemed a breach of obligations.

5.3. The disclosure of information in accordance with reasonable and applicable legal requirements shall not be deemed a breach of obligations.

6. Loss or unlawful disclosure of personal data and liability of the Seller

6.1. If, despite all measures taken by the Seller to protect personal data, the loss or unlawful disclosure of personal data occurs, the Seller shall inform the Customer of the loss or unlawful disclosure of personal data.

6.2 The Seller together with the Customer shall take all necessary measures to prevent losses or other negative consequences caused by the loss or unlawful disclosure of the Customer's personal data.

6.3 In case if the Seller fails to fulfil its obligations the Seller shall be liable for the losses incurred by the Customer due to the unlawful use of personal data in accordance with the legislation of the Russian Federation.

6.4 In case of loss or disclosure of confidential information the Seller is not liable if the confidential information:

Became public prior to its loss or disclosure;
Was received from a third party prior to its receipt by the Seller;
Has been disclosed with the consent of the Customer.

7. Withdrawal of consent for processing of personal data and rectification of personal data

7.1 If the Customer wishes to rectify the personal data in case the personal data are incomplete, inaccurate or irrelevant, or wishes to withdraw its consent for processing of personal data, the Customer should send an official request to the Seller in the form of an email to the following address: ism-shop@internationalschool.ru. The email should include the email address used when registering on the Website and the relevant request. Upon withdrawal of the consent for processing of personal data, the Customer shall also refuse to receive the newsletters and withdraw the Account on the Website.

7.2 Upon receipt of the Customer's withdrawal of consent for processing of personal data, the Seller shall block and anonymize the personal data relating to the relevant Customer not later than in three working days from the moment the Customer or its legal representative requests it.

8. Dispute settlement procedure

8.1. A claim (written offer for voluntary of a dispute) shall be submitted prior to taking legal action in disputes arising from the relationship between the User/Customer and the Seller.

8.2. The recipient of the claim shall notify the claimant of the outcome of the claim in writing within 30 (thirty) calendar days of the receipt date.

8.3. If the dispute is not resolved by negotiation, the dispute shall be referred to the court at the location of the Seller in accordance with the applicable laws of the Russian Federation.

8.4. The present Policy and the relationship between the User/Customer and the Seller shall be governed by the applicable laws of the Russian Federation.

9. Final provisions

9.1. The present Policy applies only to the Website http://ism-shop.ru/. The Seller has no control over and is not responsible for any third party websites which the User may access through the links available on the Website.

9.2. The present Policy may be amended by the Seller at any time and without any prior notice to the User/Customer. A new version of the Policy shall take effect as soon as it is posted on the Website, unless otherwise provided by the new version of the Policy.
